Apple wins a round in fight over accessing locked iPhones in criminal investigations

Los Angeles Times | February 29, 2016 | 4:07 PM
Apple won the latest round in its battle with the U.S. government over accessing iPhones in criminal investigations on Monday when a federal judge said he would not force the technology company to assist in a drug probe.
In a New York case that mirrors the legal wrangling unfolding over the FBI investigation into the San Bernardino mass shooting, U.S. Magistrate Judge James Orenstein denied a request from federal prosecutors that he make Apple unlock a drug dealer's iPhone.

An opinion........

I feel the need to drop a little truth on y'all. So buckle up...I'm about to be politically incorrect.
We don't need to take America back. No one stole it. It's right here...you're sitting in it. Chillax.
Mexico isn't going to pay for the wall and we're not going to deport millions of people and break up families. If you think either one is a good idea, you're not smart and probably not a person I want to hang out with.
We don't live in a democracy. Technically we are a Federal Republic. But in reality we are ruled by an oligarchy. If you don't know what that is, look it up. Reading will do you good. You probably need to do more of it.
FoxNews, CNN, and MSNBC have an agenda and are not "fair and balanced" or in any way unbiased. I'll reiterate...read more. Read newspapers (even online ones). Read lots of opinions and sources and then (stay with me here), THINK! Form your own opinion based on as many facts as your can brain can tolerate.
Speaking of facts...there actually is a difference between facts, opinions, and propaganda. You should learn the difference. (Another opportunity to show off your mad reading skills.)
Science is real. We know things because of science. Don't be afraid of it. You have an iPhone and Facebook because of science. It's your friend.
Global warming or "climate change" as the cool kids call it IS REAL. Anyone who tells you it's not real is not a smart person and probably should not be dressing themselves or caring for children.
Racism exists. And you are probably a little racist and should work on that. Seriously.
American Christians are not under attack. We are not being persecuted. We wield so much power in this country that politicians pretend to be Christian just so we will vote for them. No one is trying to take your bible away from you. The gay people are not destroying our families—we don't need any help from them, thank you. We do a fine job of that by ourselves. So stop saying we are persecuted. You sound stupid.
Poor people need help. If you're not helping them but complaining about how the government helps them with your money you are not a nice person.
Be nice to the people who teach your children. Don't send them nasty emails or yell at them. Their job is 10,000 times harder than your stupid job. You are not a professional educator so just shut your mouth and be thankful someone is willing to teach your offspring.
You don't know what Common Core is. You think you do, but you don't unless you're a teacher. So stop complaining about math problem memes on Facebook. You can't do the math anyway.
ISIS is not an existential threat to the United States. We do not need to rebuild our military. Our military is the strongest, scariest, most badass killing machine the world has ever seen. So stop being afraid and stop letting politicians and pundits scare you.
Guns do in fact kill people. That's what they are designed to do. If you feel you need a gun to protect yourself in America, you are probably living in the wrong neighborhood and should move before you go out and buy a gun. There are like a billion places to live where you won't need a gun, or even need to lock your front door.
If you do own a gun, then make sure you know how to use it really, really, really well. Seriously...get some training because you still don't know how to record stuff with your DVR. Go to the gun range and shoot the thing a lot. Learn how to clean it properly and be able to disassemble it and reassemble it with your eyes closed. It's a freaking gun and it deserves that level of care, proficiency and respect. And for God's sake, keep it locked up and away from your kids.
If you are even a little bit crazy, sad, or pissed off...you shouldn't have a gun. And the Founding Fathers would totally agree with me.
Stop being suspicious of American Muslims. I guarantee the guy sitting next to you in the cubicle at work is probably more of a threat to you than any Muslim. He has to listen to your uninformed ranting day after day and has probably already imagined very colorful and creative ways to end you.
Rush Limbaugh, Sean Hannity, Glenn Beck, and all the rest are ENTERTAINERS! Stop getting your opinions from them. (Here's where that reading thing can really be an advantage.)
Stop sharing Facebook memes that tell me to share or else Jesus won't bless me with a laundry basket full of cash. That's not how prayer works. And I don't want money delivered (even from God) in a laundry basket. Nobody ever washes those things out and they just keep putting nasty dirty clothes in them. Yuck!
We are the United States of America and we can afford to house every homeless veteran, feed every child, and take in every refugee and still have money left over for Starbucks and a bucket of KFC.
Unless you can trace your family line back to someone who made deerskin pants look stylish and could field dress a buffalo, you are a descendent of an immigrant. Please stop saying that immigrants are ruining our country. Such comments are like a giant verbal burrito stuffed with historical ignorance, latent racism, and xenophobia all wrapped in a fascist tortilla.
That's all for now. I feel better.

Federal Court Rules You Can Be Arrested Simply For Filming The Police

A federal appeals court in the Eastern District of Pennsylvania has ruled that filming the police without a specific challenge or criticism is not constitutionally protected.
The cases of Fields v. City of Philadelphia, and Geraci v. City of Philadelphia involve two different incidents where individuals were arrested for filming the police. Richard Fields, a Temple University student, was arrested after stopping to take a picture of a large group of police outside a house party. Amanda Geraci, a legal observer with CopWatch Berkeley, attended a large protest against fracking in September 2012 and was arrested while filming the arrest of another protester.

Both Fields and Geraci are seeking damages from the Philadelphia Police Department for violating their Constitutional right to videotape public officials. Previous rulings have found the public has a right to record police as form of “expressive conduct,” such as a protest or criticism, which is protected by the First Amendment.
The appeals court was specifically tasked with finding out whether or not the public has a First Amendment right to photograph and film police without a clear expression of criticism or challenge to police conduct.
Fields’ and Geraci’s alleged ‘constitutionally protected conduct’ consists of observing and photographing, or making a record of, police activity in a public forum. Neither uttered any words to the effect he or she sought to take pictures to oppose police activity. Their particular behavior is only afforded First Amendment protection if we construe it as expressive conduct.
The court ultimately stated, “We find no basis to craft a new First Amendment right based solely on ‘observing and recording’ without expressive conduct.”
“Absent any authority from the Supreme Court or our Court of Appeals, we decline to create a new First Amendment right for citizens to photograph officers when they have no expressive purpose such as challenging police actions,” the decision concluded.
Eugene Volokh, a professor of law at UCLA, disagrees with the decision and says he believes it will eventually be overturned by the Third Circuit Court upon appeal.
“Whether one is physically speaking (to challenge or criticize the police or to praise them or to say something else) is relevant to whether one is engaged in expression,” Volokh wrote in the Washington Post. “But it’s not relevant to whether one is gathering information, and the First Amendment protects silent gathering of information (at least by recording in public) for possible future publication as much as it protects loud gathering of information.”
Whether or not the ruling is overturned, it should serve as a reminder to all free hearts and minds that the cost of liberty is eternal vigilance. We cannot become passive and allow the ruling class and despots in government to subvert our path towards liberation. Now more than ever we need communities to actively organize cop-watching and politician-watching campaigns that encourage accountability and transparency.  We must also remain strong in our sense of morality and principles, and not allow what is “legal” or “constitutional” to limit us in our fight for freedom.

‘Jesus Killed The Sodomites’: Walid Shoebat Furiously Attacks Anti-Gay Activists Who Criticized His Son

‘Jesus Killed The Sodomites’: Walid Shoebat Furiously Attacks Anti-Gay Activists Who Criticized His Son

By On · no Comments · In

Extremist anti-gay activist Theodore Shoebat has been locked in a battle of words with other anti-gay activists for several months, ever since Peter LaBarbera of Americans for Truth About Homosexuality reportedly tried to have footage of Shoebat removed from an anti-gay documentary because of his radical views.
Shoebat was featured in Janet Porter’s “Light Wins” film last year, along with a variety of anti-gay activists and several Republican presidential hopefuls and members of Congress. Once we began to post clips of Shoebat openly calling for a global Inquisition that would put all gays to death, LaBarbera reportedly sought to have Shoebat removed from Porter’s film, which eventually led to Shoebat attacking LaBarbera as a “filthy pig” and a “traitor.”
The fighting has only escalated in the wake of Shoebat’s recent assertion that Jesus would have personally beaten gays to death, which was denounced by LaBarbera, as well as by fellow anti-gay activist Michael Brown.
This did not sit well with Shoebat’s father, Walid, a supposed “ex-terrorist” who posted a furious screed on his website attacking LaBarbera, Brown, Matt Barber and anyone else who has dared to criticize his son’s extremist views, accusing them of worshiping gay blogger Joe Jervis of Joe.My.God instead of the one true God:
So how much will the Evangelical movement in the United States go to please the LGBT agenda?
When Shoebat.com posted this video on four homosexual wrestlers who raped two boys calling for a death penalty for these rapists, it upset one blaspheming homosexual and Right Wing Watch. These taunted the Evangelical movement causing an uproar with top level leaders calling on them to denounce Shoebat.com. They quickly lined up to show their support and denounced Shoebat.com for calling for the “death penalty” for gay rapists.
Several Evangelical leaders began hurling denunciations and articles against our infamous Theodore Shoebat for his views calling for the death penalty for rapists and child molesters.
According to these Evangelical leaders, calling for the death penalty for gay rapists, gay child molesters is  ‘unchristian’. The heavyweights from Calvinist John Piper to Dr. Michael Brown, Peter LaBarbera (1), Matt Barber and others were irate at Theodore’s remarks.
Who controls these leaders? One major gay activist who wraps Evangelical scholars around his finger gives himself the blasphemous title as “Joe My God,” so that when they twitter him they would blaspheme calling him “My God” instead of Christ. The trick stems from when Caesar wanted the Christian world to address him as kyrios (My lord) which St. Paul denounced by stating “that every tongue should confess that Jesus Christ is Lord” (Philippians 2:11), that is that Christ is Kyrios not Caesar.
But now, this sodomite blasphemer, Joe, has become their god instead.
To please Joe the Blasphemer they go as far as lining up to denounce the young Shoebat for calling for the death penalty to even twisting arms to scrub and edit out Theodore’s contribution in an anti-gay documentary.
Shoebat even went on to defend his son’s assertion that Jesus would kill gays, arguing that it was Christ who carried out the destruction of Sodom and Gomorrah:
Did Jesus kill gays? Nothing was ever said in this silly half-baked article that in the Bible it is as clear as the sun, Jesus killed the sodomites. Most modern theologians intentionally overlook and refuse to disclose that some of the best passages of scripture ever used regarding the Trinity and the Theophany is within the context when Christ completely annihilated the sodomites.
Anyone who denies this ask them: was it Christ Who met with Abraham and announced the destruction of Sodom? In Genesis Abraham is visited by three figures, one of whom he refers to as “My Lord” (Genesis 18:3), and Who Scripture calls “the LORD” (Genesis 18:17).
No sane theologian would argue that this person wasn’t Christ. After much feasting, Christ and the other two men left Abraham to destroy Sodom and Gomorrah (see Genesis 18:21-22). Christ even referred to His meeting with Abraham in the New Testament when He said:“Your father Abraham rejoiced to see My day, and he saw it and was glad” (John 8:56, also see St. Gregory as recorded by St. Aquinas, Catena Aurea). It was so clear in scripture that it was Christ Who killed ‘the gays.’

Manny Pacquiao Doubled-Down, Lashed Out With 'Death To Gays' Instagram Post After Nike Fired Him

Boxer Posted Infamous Bible Verses From Leviticus After Firing

International boxing star Manny Pacquiao learned Wednesday what happens when people who make their money by being public figures treat the public poorly. After saying same-sex couples are "worse than animals," and using the Bible to support his homophobia, a very outraged public waged a very public campaign to convince his sponsors to fire him.
Nike, which for many years has had a strong policy supporting equality, decided the best course of action was to part ways with the boxer and Filipino congressman. In a statement announcing his firing, Nike called Pacquiao's anti-gay comments "abhorrent."
RELATED: Nike Fires Manny Pacquiao Over 'Abhorrent' Anti-Gay Comments
Pacquiao, just hours later, lashed out.
Reportedly taking to his verified Instagram account, Pacquiao shared with the world what he truly believes about LGBT people and same-sex couples.
"Do not have sexual relations with a man as one does with a woman; that is detestable," Pacquio, quoting Leviticus, wrote, as first reported by ABS-CBN News. "If a man has sexual relations with a man as one does with a woman, both of them have done what is detestable. They are to be put to death; their blood will be on their own heads," he continued, citing another infamous Leviticus verse.
He then quoted a biblical verse that happens to be a particular favorite of other religious extremists, like Duck Dynasty's Phil Robertson.
"Or do you not know that wrongdoers will not inherit the kingdom of God?," he wrote. While the entire passage is not viewable, the rest of the verse continues: "Do not be deceived: Neither the sexually immoral, nor idolaters, nor adulterers, nor men who have sex with men nor thieves nor the greedy nor drunkards nor slanderers nor swindlers will inherit the kingdom of God."

The post was later deleted, but not before over 18,000 people had the chance to "like" it on Instagram.
Others soon picked up the story, including TMZ and Joe.My.God.
Meanwhile, Scott Wooledge, the founder of Memeographs and a NYC-based LGBT activist who was behind the successful social media campaign to convince Nike to fire Pacquiao, told The New Civil Rights Movement that we've "heard apologies from Pacquiao before and yet his rhetorical outbursts continue."
"I respect people still committed to working on educating him," Wooledge adds. "However he has shown his so-called remorse and contrition are mere crocodile tears formulated for the sake of his image and income. If he was ever truly sorry for his hurtful words, he could simply stop saying hurtful things."
There are still other megabrands that are sponsoring Pacquiao. There's more work to be done.

Boxing great Manny Pacquiao doubles down on gay slurs

Boxing great Manny Pacquiao doubles down on gay slurs

Philippine boxing great Manny Pacquiao doubled down Friday over gay slurs that have tarnished his reputation and cost him millions in endorsements, insisting God was on his side.

The eight-division world champion smiled and joked through a training session in his hometown of General Santos, then told reporters he had no intention of bowing to his critics.
"What I am saying is right. I mean I am just stating the truth, what the Bible says," said Pacquiao, 37.
Pacquiao, who converted from Catholicism to an evangelical Protestant faith late in his boxing career, ignited a global controversy this week when he described homosexuals as worse than animals.
"It's common sense. Do you see animals mating with the same sex? Animals are better because they can distinguish male from female," Pacquiao told Filipino television station TV5.
"If men mate with men and women mate with women, they are worse than animals."
An even more incendiary quote from the Bible was posted on his Instagram account early Thursday.
The quote read: "If a man has sexual relations with a man as one does with a woman, both of them have done what is detestable. They are to be put to death; their blood will be on their own heads".
The post was quickly deleted, but not before local media outlet ABS-CBN captured and published a screen shot.
A Pacquiao aide in General Santos confirmed the post went on his Instagram account.
Pacquiao issued an apology on social media on Tuesday, shortly after the initial controversy broke.
But Pacquiao, who intends to retire after his April fight against American Timothy Bradley to pursue a career in politics, signalled Friday his apology was qualified.
"What I did wrong was just comparing the people to animals, but you know what I am telling is the truth," he told reporters.
"I mean I am just telling what the Bible says. We believe God and then we should honour the word of God."
- 'Happy with God on my side' -
Pacquiao also said he was unfussed by the controversy, and that it had not affected his training or dampened his morale.
"I'm happy. I'm always happy because God is with me," he said.
One of Pacquiao's media handlers told reporters at the training session on Friday that they were not allowed to ask him any questions about the controversy.
However Pacquiao appeared eager to show he remained firm in his religious convictions, and happily accepted questions on the controversy.
Nike, Pacquiao's major global sponsor, cancelled its endorsement deal with him this week, describing his comments as "abhorrent".
"Nike strongly opposes discrimination of any kind and has a long history of supporting and standing up for the rights of the LGBT community... we no longer have a relationship with Manny Pacquiao," the statement said.
Pacquiao, one of the world's highest paid athletes for more than a decade, continued to wear his Nike apparel at Friday's training session.
Many prominent figures in the United States, where same-sex marriage is enshrined in law, also expressed revulsion this week.
Jason Collins, the first openly gay athlete in the NBA, dismissed Pacquiao as "bigoted".
"I lost all respect for you," Collins wrote on Twitter. "Bigoted people like you (& yes you are one) should never hold an office in politics."
Pacquiao's long-time rival, Floyd Mayweather -- who outclassed the Filipino in their money-spinning mega-fight last year -- also took aim at the remarks.
"We should let people live their lives the way they want to live their lives. To each his own," Mayweather was quoted by TMZ Sports as saying.
While homosexuality is not criminalised in the Philippines, gay marriage is outlawed due to strong opposition from the Catholic Church.
Eighty percent of the Philippines' 100 million people are Catholics.
The controversy has dominated the local media, and gay rights campaigners have expressed outrage.
However Philippine companies that sponsor him or had previous endorsement deals were in no rush to follow Nike's lead, with none publicly expressing concern this week.
Pacquiao, a former street kid with little education, has used his fame and fortune to launch a promising political career.
Already a two-term congressman, Pacquiao is campaigning to win a Senate seat in May elections. Surveys published before the controversy indicated he will win.
Pacquiao has said he wants to be president of the Philippines.

Church: Yes, Bishops Must Report Abuse

A commission created by Pope Francis has reaffirmed that Catholic bishops have “a moral and ethical responsibility” to report suspected child sexual abuse to civil authorities. The advice contradicts a 2015 Vatican training course that told bishops they had no obligation to report abuse charges to law enforcement under church law. The commission issued a statement in the name of Cardinal Sean P. O’Malley of Boston, saying, “As Pope Francis has so clearly stated, ‘The crimes and sins of the sexual abuse of children must not be kept secret for any longer. I pledge the zealous vigilance of the church to protect children and the promise of accountability for all.’ Our bishops’ charter clearly states the obligation that all dioceses [and] eparchies and personnel report suspected abuse to the public authorities.”

Pacquiao: Gays Are ‘Worse Than Animals’

Manny Pacquiao—the boxing world champion, politician, and part-time pastor—apologized Tuesday for saying that gays “are worse than animals.” The athlete, who is running for a seat in the Philippines senate, said in an interview, “Do you see animals mating with the same sex? Animals are better because they can distinguish male from female.” Pacquiao’s comments upset many, including Filipino comedian Jose Marie Borja Viceral, who said, “Some people think they can judge people like God just because they’ve attended a prayer meeting and read the Bible.” Pacquiao now serves as a member of the Filipino house of representatives. Pacquaio swiftly rowed back on his remarks, writing on his Facebook page: “Please forgive me for those I’ve hurt. I still stand on my belief that I’m against same-sex marriage because of what the Bible says, but I’m not condemning LGBT.”

“I want to apologise especially to the coach, I can only thank him for all he has done for me since I arrived in Paris. He wanted me and since I came here everything has gone really well. I owe him a lot and that is why I apologise sincerely to him for what was said, which I deeply regret.
“I will accept any sanction the club impose on me regarding this incident. I made a mistake, it was unforgivable and I am ready to face all the consequences.”
Aurier, a key player in the PSG side, also aimed derogatory comments at keeper Salvatore Sirigu, defender Gregory van der Wiel and striker Edinson Cavani.
The club’s senior pros are said to have refused to play alongside the 23-year-old Ivory Coast international again.
And furious PSG president Nasser Al-Khelaifi has also suggested Aurier is finished at the club, who host the Blues on Tuesday night in the first leg of a Champions League last-16 tie.

Unhappy: PSG owner Al-Khelaifi immediately made comment about the video
In a statement, Al-Khelaifi said: “I took the decision to dismiss Serge Aurier. Paris Saint-Germain is a very strong institution which nobody can touch.
“This video, filmed in a private setting, clearly contains unacceptable comments about team-mates and especially coach Laurent Blanc.
“PSG wishes to express its fullest support to coach Blanc and to to the players who have rightly felt offended by Aurier’s remarks.”
